  • Amends the definition of tobacco products to include electronic smoking devices

PHILADELPHIA

  • Prohibits the use of electronic smoking devices in public places and in the workplace with limited exclusions for some private establishments whose primary purpose is smoking or use of electronic smoking devices

SAN FRANCISCO

Amendments to the Health Code

Implemented April 2014

  • Amends the Health Code to prohibit the use of electronic cigarettes where smoking is otherwise prohibited

  • Requires a tobacco permit for the sale of electronic cigarettes

  • Prohibits the sale of electronic cigarettes where the sale of tobacco products is otherwise permitted

CHICAGO

Amendments to the City of Chicago Municipal Code: Chapter 4-64

Implemented April 2014

  • Amends the definition of “smoking’ to include all electronic cigarettes, including vape pens and e-hookah

  • Amends the definition of a “tobacco product” to include e-cigarettes

  • Prohibits the use of e-cigarettes in any place where smoking is prohibited, without exception for adult-only bars and restaurants

  • Prohibits the sale of tobacco products at self-service displays or to minors under age 18

  • Requires products to be kept behind the counter, out of the reach of kids

  • Requires retailers to obtain a tobacco license

  • Retailers caught selling to children face steep fines; can have tobacco license revoked

  • E-cigarettes will become part of the City’s existing undercover sting operations

  • Prohibits the sale of flavored e-cigarettes within 500 feet of a school

NEW YORK

The New York City Council, Amendment to the Smoke-Free Air Act
